State Appeals

Under Alabama law, you have a right to appeal any prior conviction or sentence. In order to preserve your rights, you must file a notification with the Court of Appeals stating that you desire to appeal your case. Time limitations apply to all state appeals, just as they do to federal appeals. The Alabama Court of Criminal Appeals hears all appeals of felony and misdemeanor cases, including violations of city ordinances and all post-conviction writs in criminal cases. If the Alabama Criminal Appeals Court denies your appeal you still have the right to petition the Supreme Court of Alabama. If your case involves a question of federally protected rights you can even petition the United States Supreme Court for review of the State decision.

Federal Appeals

You have a right to appeal a federal conviction or sentence to the U.S. Court of Appeals. The United State Court of Appeals for the Eleventh Judicial Circuit has jurisdiction over federal cases originating in the states of Alabama, Florida and Georgia. The circuit includes nine district courts with each state divided into Northern, Middle and Southern Districts. If you were previously convicted of a federal crime in the Northern District of Alabama, the Middle District of Alabama, or in the Southern District of Alabama, and believe your conviction or sentence wrong or unjust, please contact Eversole Law Offices to discuss your appeal.
